Trademark opposition.

Assess an opposition or proposed challenge and coordinate pleadings, evidence and representation as required.

Scope before commitment Requirements explained
01 / THE BIG PICTURE

The right support.
With the details in view.

Address a third-party trademark dispute with an organised case file and a clear procedural plan. We help assess grounds, deadlines, pleadings and evidence for an opposition or defence, coordinating qualified representation where needed. The merits and procedural stage determine the approach; outcomes cannot be assured.

First, establish what applies

Search, application, examination and grant or registration are different stages. Assess ownership, prior rights, classes and evidence with the relevant IP professional; an application does not guarantee protection.

What the scoped work can cover

  • Opposition or defence assessment
  • Agreed pleadings and indexed evidence package
  • Proceedings tracker and hearing or settlement action note
02 / GET READY

The documents.
A clearer starting point.

Use this as a preparation list for the initial review. The final checklist is confirmed against the applicant, service route, location and current authority requirements.

03 / HOW IT MOVES FORWARD

One step.
Then the next.

A clear sequence, with room to resolve the details that are specific to your business.

  1. 01

    Assess position and timing

Confirm the party’s role, grounds and the procedural deadlines from the actual file.

  2. 02

    Prepare pleadings

Coordinate the notice of opposition or counterstatement with facts and the legal position.

  3. 03

    Organise evidence

Prepare the appropriate evidence record and respond to the other party’s case as required.

  4. 04

    Manage proceedings

Coordinate hearing preparation, instructions and any separately agreed settlement discussions.

Scope, fees and timing are agreed after review. Document readiness, professional review and any authority queries affect the schedule. Statutory charges, testing, execution and other third-party costs are identified where relevant.

04 / BEYOND THIS STEP

Keep the next
responsibility in view.

Track orders, appeals and settlement commitments, and update the brand’s enforcement and filing strategy as appropriate.

05 / A LITTLE MORE CLARITY

Good questions.
Useful answers.

01Can I oppose a mark before it is advertised?+

The opposition route is linked to advertisement and the applicable statutory window. Other concerns before that stage need a separate assessment.

02Is a counterstatement optional?+

A failure to respond appropriately can have serious consequences for an application. The actual notice and service date should be reviewed promptly.

03Does opposition stop all use of a brand?+

Registry opposition concerns registration. Claims about use, infringement or an injunction may require separate legal proceedings.

OFFICIAL STARTING POINTS

Reviewed 20 October 2026. Requirements and effective dates should be rechecked for the actual application or transaction.
